Terms of Service

These terms are the agreement between you and Webit365 Inc. (“Webit365 Inc.”, “we”, “us”) for using Webit365 Studio (the “Service”). We've kept them plain. By building, previewing, subscribing to, or editing a website with the Service, you agree to them.

1. What the Service is

Webit365 Studio helps small businesses create and run a website. Your site is generated and edited using artificial intelligence, including our assistant “Presto,” which you can direct by typing or by speaking. You stay in control: you review your site and choose what to publish.

2. Your account & eligibility

You need an account to keep and manage a site. You're responsible for the information you provide and for activity under your account. Give us accurate details and keep your sign-in secure. You must be at least 18 years old (or the age of majority where you live) and use the Service for a real business.

3. Staying in touch

When you sign up, you agree that we may email you about your account and your site — sign-in help, receipts, renewals, and important service notices (these keep the Service running, so they aren't optional). We may also send occasional news, tips, offers, and product updates; you can unsubscribe from those marketing emails anytime, and we'll still send the account ones.

4. Subscriptions & billing

  • Each live website is a monthly subscription, billed through our payment processor, Stripe.
  • Building and previewing a site is free. You pay only when you choose to publish and keep it.
  • Your subscription renews automatically each month until you cancel. Prices are shown before you buy.
  • Canceling and refunds are covered in our Cancellation & Refunds policy.

5. Credits

Some actions use credits. Your plan includes a monthly credit allowance (it doesn't roll over), and you can buy additional credits, which stack on top and don't expire while your account is active.

  • Typing your own copy, changing colors, and uploading your own photos are free. Credits are used for things we generate or improve for you — such as creating photos, improving written copy, or making a logo. The cost is always shown and you confirm before any credits are spent.
  • Credits pay for the work, not a specific result. AI tools are powerful but not perfect, and results can vary — especially images. When you approve an action, the credits are used to perform it whether or not the result is exactly what you pictured. For that reason, credits already spent are not refundable.
  • If something isn't right, you can simply try again (each new attempt is a new action). Presto is built to help you get there. And if you ever feel a result was clearly wrong, tell us — we're reasonable people.

6. AI-generated content — please review before you publish

Because your site is created and edited with AI (including spoken-voice edits), the words and images may contain mistakes, may not perfectly reflect your business, or may need a human touch. You are responsible for reviewing your site and deciding what goes live.

We do not guarantee any particular result, including the accuracy of generated content, search-engine or AI-search rankings (SEO/AEO), or that a site meets any specific accessibility standard (such as WCAG). We also don't promise that a website will bring in customers, sales, or any particular business result. We build with good practices in mind, but these outcomes depend on many factors outside our control.

7. Your content, and how the website works

The words and images you add — including photos we generate for you — are yours to use. You can copy your text and download your images anytime to keep or use elsewhere. You're responsible for having the rights to what you upload and for keeping your site's content lawful and honest.

The website itself is a service we host for you — not a file you own or can take with you. It's tied to your subscription and built on our platform, so it isn't transferable and can't be exported or migrated to another host, and we aren't responsible for moving a site elsewhere. If you ever move on, you're welcome to take your content with you; the site build and setup stay with us.

8. Acceptable use

Please keep your site clean and lawful. Don't use the Service for anything unlawful, deceptive, or harmful, don't infringe others' rights, and don't try to break, overload, or misuse the platform. In particular, sites may not contain pornographic, sexually explicit, or other adult content; content promoting illegal drugs or illegal activity; or hateful, violent, or harassing content.

To keep the platform safe, we may review any site at any time. If a site breaks these rules we may suspend or remove it, and a site taken down for a violation isn't refunded for the current billing period. Where we reasonably can, we'll give you a heads-up and a chance to put it right first.

9. Analytics & tracking you add

You may be able to connect analytics and marketing tools to your site — for example a Google Analytics or Google Search Console property, or a Meta (Facebook) Pixel. If you do, those tools collect data through your site under their own terms, and you're responsible for using them lawfully, including any privacy notices or cookie consent your visitors are owed where you operate.

10. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties we haven't expressly made, including fitness for a particular purpose and uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent allowed by law, Webit365 Inc. isn't liable for indirect, incidental, or consequential damages, or for lost profits or data. Where liability can't be excluded, our total liability is capped at the amount you paid us for the Service in the three months before the claim — that is a ceiling on what we could owe, not a promise of a refund.

12. Changes to these terms

We may update these terms as the Service evolves. If we make a material change, we'll take reasonable steps to let you know. Continuing to use the Service after an update means you accept the new terms.

13. Governing law

Webit365 Inc. is a United States company. These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and any disputes will be handled in the courts located there.
